The subscriber agrees to indemnify and hold harmless leadsNyou Systems from any claims resulting from the use of the service which damages the subscriber or any other parties.

Spamming using leadsNyou Systems is STRICTLY prohibited. leadsNyou reserves all rights to terminate subscriber account without refund in this case. If leadsNyou's service is interrupted as a result of subscriber's spamming, leadsNyou will bill the subscriber at $500.00 per hour until service is restored. Subscriber will also be in violation of the leadsNyou Systems Service Agreement and subject to legal action.

Using purchased leads with an leadsNyou account is strictly prohibited.

Using any sort of programming to automate addition of contacts through signup form on behalf of a website visitor is strictly forbidden.

Sex-related data storage or transmission using leadsNyou Systems is strictly prohibited.

You agree that leadsNyou shall be permitted to charge your credit card on a monthly basis in advance of providing its services, for your subscription fee (based on your plan selection). The subscription fee will be billed in full on the first day of your paid subscription and on each subsequent month thereafter, unless and until you cancel your subscription. leadsNyou is not responsible for any additional bank fees, interest charges, finance charges, over draft charges, or other fees resulting from charges billed by leadsNyou. Currency exchange settlements will be based on agreements between you and the provider of your credit card. In addition, we do not offer refunds for unused time if cancellation is initiated during the middle of a billing cycle. We also reserve the right to change our fees, however we will note the updated price(s) on our site. If there is a specific duration and price for your current services, then that price will remain in effect for such duration, but continued use of leadsNyou services thereafter may be at the new price. leadsNyou automatically renews your service at the completion of the cycle period selected when signing up. leadsNyou will auto renew based on the plan selection that you selected initially and will invoice you according to your initial payment selection. All charges are non-refundable unless expressly stated otherwise, or otherwise provided by applicable law. The costs of any returns if permitted will be at your expense, unless otherwise provided by applicable law.

Accounts unpaid 20 days after date of invoice may have their service interrupted. Such interruption does not relieve the subscriber from the obligation to pay the monthly charge. Only a written request to terminate your service relieves you of your obligation to pay the monthly account charge. Accounts in default are subject to a late payment charge of $25 and an interest charge of 1.5% per month on the outstanding balance. If the subscriber's state law does not allow an interest rate of 1.5% per month, the maximum allowable rate for the subscriber's state will be charged. If the subscriber defaults, the subscriber agrees to pay leadsNyou Systems its reasonable expenses, including attorney and collection agency fees, incurred in enforcing its rights under these Service Agreement.

If the payment is not received after 20 days from the date of invoice, leadsNyou reserves rights to terminate the subscriber's account. The subscriber agrees that the company has the right to delete all data, files or other information that is stored in the subscriber's account if the subscriber's account with the company is terminated, for any reason, by either leadsNyou Systems or the subscriber.

leadsNyou Systems shall have the right to suspend service to the subscriber at any time, and for any reason, without notice. If such a suspension is to last for more than 20 days, the subscriber will be notified as to the reason.

leadsNyou Systems exercises no control whatsoever over the content of the information passing through leadsNyou Systems. All leads (email addresses) generated by subscriber are held strictly confidential. The leads are never released to any other parties for any purpose. The lead information is only used on leadsNyou Systems' servers to deliver the follow up messages designated by the subscriber.

leadsNyou Systems makes no warranties of any kind for the service it is providing. leadsNyou Systems also disclaims any warranty of merchantability or fitness for a particular purpose. leadsNyou Systems will not be responsible for any damage suffered. This includes loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions caused by leadsNyou Systems' negligence or the subscriber's errors or omissions. Use of any information obtained via leadsNyou Systems is at your own risk. leadsNyou Systems specifically denies any responsibility for the accuracy or quality of information obtained through its services.

USE OF LEADSNYOU SYSTEMS SERVICE CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS.
